In the USA, you need special regulatory approval to apply chemicals with spray drones. This approvals process is slightly different if you are flying above or below 55lbs. The following document outlines the certifications required to legally use a spray drone, and how to get each certification. These licenses are not required to spray water for flight practice as long as the drone remains below 55lbs at all times.
Hylio helps customers by providing information about the process, as well as filing 44807 exemptions for those who purchase new drones. Aside from the 44807 exemptions, every other item on this list is the user’s responsibility to complete
In June of 2023, the FAA instituted a number of changes to their spray drone policies. These changes include speeding up the 137-certification process, as well as loosening restrictions on the over 55lb 44807 exemptions. In March 2024, the FAA allowed multi ship operation of aircraft over 55lbs. In June 2024, the FAA changed their requirements for 44807 approvals. This tab reflects all of these rule changes
1. Obtain Part 107 Drone Pilot License (~1 month)
Obtain State Pesticide Applicator License (~1 month) (Information varies by State)
Obtain Class 3 Airman’s Medical Certificate (~1 week)
All three items can be done at any time before or after aircraft is received
2. Receive aircraft from Hylio
3. Submit aircraft registration (1-3 months)
FAA typically will not allow registration without FAA Form 8050-2 – Aircraft Bill of Sale. This form is used by the FAA for legal transfer of ownership (the drone “pink slip”). Hylio cannot send the Bill of Sale ahead of the aircraft itself.
4. Submit Section 44807 Exemptions
Hylio submits on your behalf when requested. Typically approved in 4-8 months
5. Submit Part 137 Application Form 8710-3 (~2 weeks)
(Cannot submit 8710-3 until 107, Aircraft Registration, & 44807 are all complete)
6. Receive Part 137 Certificate > Self-Administer 137 Knowledge & Skills Test (Must keep up to date regarding equipment and personal)

∗∗ Section 44807 Expires every 24 months, FAA expects you to apply for renewal 120 days before expiration. If you let it expire you’ll need to petition the FAA for a completely new exemption
